For over 20 years, the Flores Settlement Agreement has required the U.S. Government to release children in detention as soon as possible to their parents, guardians, relatives, or vetted entities. In early September, the Department of Homeland Security and the Department of Health and Human Services proposed a regulation that, among other things, would eliminate this requirement and allow the indefinite detention of children.
The departments say this change is necessary to prevent separating children from their parents. It would give them the authority to keep children with their parents, even while their parents are in detention. But the fact is, both family separation and detention are bad for children. Detaining children for immigration purposes is a violation of children's rights and unnecessary, especially when there are proven community-based alternatives to detention.
